But it must be well drafted, recognised in Spain and given to the right person.<\/p>\n<h2>What is a Spanish notarised power of attorney?<\/h2>\n<p>It is a power (poder notarial) by which you authorise a representative to act in your name: applying for your <a href=\"https:\/\/achetermalincostabrava.com\/en\/buying-a-house-on-the-costa-brava\/what-is-the-nie-and-how-to-get-one\/\">NIE<\/a>, opening an account, signing the arras contract or the deed of sale, paying the taxes linked to the purchase. It can be very broad or limited to one specific transaction; for a purchase, we recommend a targeted power of attorney.<\/p>\n<h2>Three ways to sign it from France<\/h2>\n<ul>\n<li>At the Spanish consulate for your area, which acts as a Spanish notary. This is often the simplest route, but you need to get an appointment.<\/li>\n<li>Before a French notary, followed by an apostille and a sworn translation into Spanish.<\/li>\n<li>Directly before a notary in Spain, during one of your trips, for example during viewings.<\/li>\n<\/ul>\n<p>In every case, have the draft power of attorney checked by whoever will use it: a badly worded one can be refused on the day of signing.<\/p>\n<h2>Who should you give it to?<\/h2>\n<p>The representative must be a trusted person or professional, often a lawyer or a gestor\u00eda. They act in your name, with your money: make sure they report back on every step. Once the purchase is complete, you can revoke the power of attorney before a notary.<\/p>\n<h2>Do you have to do everything remotely?<\/h2>\n<p>Not necessarily.
